Terms and Conditions
Subject matter
These terms and conditions shall govern the sale through nanjewels.com, of products marketed by Libellula snc, with its seat at Piazza Gaetano Salvemini, 6, 50122 Firenze FI – Italy. By concluding the contract of sale, the Customer undertakes to comply with the following conditions of sale that Libellula snc recommends to save in electronic copy or, in any case, keep in any other form.
The products offered are listed and illustrated on the pages of this website, within their respective sections and product categories. These representations correspond to the photographic image of the products themselves; however, since they are handcrafted products, Libellula snc does not guarantee the exact conformity (e. g. with reference to chromatic and/or dimensional aspects) of the image depicted and/or the indications given in the information sheet with the real object that will be sent following the order.
The type of products published and their availability may vary at any time, so the ability to respond positively to requests for order made by the Customer. The impossibility to accept an order request or the temporary unavailability of the products will not imply any responsibility towards the Customer.
Methods of purchase
The Customer can only buy products available in the catalog at the time of placing the order and viewable online at the address nanjewels.com, as described in the relevant information sheets. The order confirmation will be sent by Libellula snc by e-mail, to the e-mail address given by the Customer within approx. 24 hours after placing the order. This confirmation message will contain the lead time of execution of the order and an “Order Number” to be used in any subsequent correspondence with the seller. The message will also contain all the data entered by the Customer, who agrees to verify the correctness and to communicate any corrections promptly within 24 hours of receipt of the order confirmation. Any additional costs caused by late or incorrect communication and request for correction of data will be at the sole expense of the Customer.
Orders will be stored in the database of Libellula snc, pursuant to the privacy policy provided on our website.
Prices and methods of payment
All prices are indicated in Euro and published together with the products and do not include shipping costs. The Customer may pay the price and the contribution to the shipping costs by means of PayPal or Credit Card pursuant to the terms indicated on the website nanjewels.com. Libellula snc cannot not be held responsible for any delays or malfunctions of PayPal or the Customer’s bank.
Shipping and delivery of products
Libellula snc undertakes to deliver the product to the carrier in charge of shipping within the number of working days indicated in the product sheet. This period may be suspended by Libellula snc in the event of non-receipt of the payment provided for by PayPal or Credit Card and until the payment has been received. Libellula snc is not able to directly control the delivery of products after handing over to the carrier in charge of shipping; for this reason, it cannot be held in any way responsible for any late delivery time.
The Customer, or another person appointed by him/her, who is at the address indicated for the delivery of products, is required to verify, at the time of delivery:
- the exact conformity of the products with what is indicated in the transport document of the carrier (DDT), as regards the number, type and quality of the product;
- that the packaging and wrapping of the products are undamaged and not altered.
In the absence of the characteristics of completeness and accuracy referred to in the preceding points, the Customer must proceed to the immediate complain indicating the reasons on the transport document that the carrier must report to Libellula snc. Failure to complain within the deadlines set forth shall automatically result in acceptance of the product and the consequent forfeiture of the right to enforce the warranty for the defects referred to in this clause.
In the event of non-delivery due to the Customer’s fault, all costs in relation with any new shipment shall be borne by the Customer.
WARNING!
Items in your order that are designated for shipment to countries outside of EU may be subject to taxes, customs duties and fees levied by the destination country (“Import Fees”). The recipient of the shipment is the importer of record in the destination country and is responsible for all Import Fees.
Import Fees must be paid by the person receiving the package when it reaches its destination.
If you refuse a shipment from Libellula snc, you are responsible for the original shipping charges, any Import Fees that are incurred on the package, and the cost of returning the package to Libellula snc. This amount will be deducted from your merchandise refund.
Right of withdrawal
If the Customer is a “consumer”, he/she has the right, pursuant to and for the purposes of Article 52 et seq. of Legislative Decree no. 206/2005, to withdraw from the contract of sale within 14 days as from the date of receipt of products. The right of withdrawal must be exercised by the Customer by sending a written notice by registered letter or by e-mail to info@nanjewels.com asserting his/her willingness to make use of this right while indicating the “Order Number”.
If the Customer exercises his/her right of withdrawal, he/she must return the products within 14 working days as from the date of notice of withdrawal and bear all costs associated with the return. The products along with their packaging and/or wrapping must be returned intact. The shipment, until the certificate of receipt, is subject to the full responsibility of the Customer. The refund of the price is subject to the correct exercise of the right of withdrawal pursuant to the terms indicated above. The right of withdrawal cannot be exercised by the Customer in the cases provided for in Article 59 of the Italian Consumer Code [Codice del Consumo] and, in particular, for bespoke or customized products.
Warranty
The warranty provided for by the regulations in force applies to products with a conformity defect, provided that they are used correctly and in compliance with their intended use. The Customer who has the status of “consumer” is entitled to the rights under Art. 130, to be exercised pursuant to Art. 132 of the Consumer Code, by means of a complaint sent by registered letter or email to the address: info@nanjewels.com
Intellectual property rights
All intellectual property rights related to products sold on nanjewels.com belong exclusively to Libellula snc. The relevant images may not be reproduced or used without the prior written consent of Libellula snc. Any reproduction or use that is not authorized under these Terms & Conditions and/or the applicable rules and/or in writing by Libellula snc is not permitted.
Applicable law and jurisdiction
The contract of sale between the Customer and Libellula snc is concluded in Italy and governed by Italian law. For the resolution of disputes related to this contract, where the Customer is a consumer, the competent court shall be the court of the Customer’s place of residence; in all other cases, the Court of Florence shall be exclusively competent.
